Nike 6.0 and Foam Magazine present Living Life Full Online Photo Contest

Foam readers, like the 6.0 athletes, Monyca, Carissa, Lakey and Ellery, are constantly on the move: creating, socializing, surfing, snowboarding, giving back and making change - Living Life Full.

To celebrate the launch of the Nike 6.0 Women's line, Nike 6.0 and Foam Magazine want you to send in your best photo or collection of photos (3-5) that capture what it means to be Living Life Full.

To enter, all you need to do is submit this entry form and then create an article with your photos. The subhead of your article must read Living Life Full. Make sure to review the rules below as they include photography guidelines.

Need some inspiration on what Living Life Full looks like? Olivia Bee, Nike 6.0's artistic muse, offers it up in spades. Olivia Bee is a photographer from Portland, Oregon who uses her camera as a visual diary. At the age of 11, she picked up her first camera and has been at it non-stop ever since. She documents the fun and aesthetic beauty of being a teenager. She is inspired by her everyday life, relationships, culture and places that hold memories.

The photo contest winner will receive a full Nike 6.0 Women's wardrobe from the Holiday 2010 line and her winning photograph will be featured in the November issue of Foam so hit us with your best shot and you'll be rewarded big time.

NCAA/High School ELIGIBILITY.

I understand and agree that if I am a student-athlete I am responsible for my own collegiate/high school eligibility and/or amateur standing. I am aware of, and agree to comply with, all rules, regulations, and bylaws of my high school state association and of any national federation responsible for administering or regulating interscholastic athletics, and of the NCAA or other regulatory authority, that may be applicable to my participation in the Contest I understand the consequences of any failure to comply with such rules, including but not limited to, loss of my eligibility to participate in future athletic contests in any sport at the high school, collegiate or other level. SPONSORS (defined below) ARE NOT RESPONSIBLE OR LIABLE FOR YOUR PARTICIPATION IN THIS CONTEST RESULTING IN YOUR INELIGIBILITY AS AN AMATEUR ATHLETE.

You agree that your participation in this Contest is subject to the Terms of Use and Privacy Policy located at: http://foammagazine.com/articles/95-privacy-policy. Terms for User include, but are not limited to, the following:

If you are between 13 and 18 years old, you must have your parent/guardian's permission to use or post Generated Content (“UGC”) to the Contest site.

Sponsors do not prescreen UGC. Sponsors retain the rights but not the responsibility to edit or remove any UGC or terminate your account for any reason in its sole discretion.

Your UGC is not confidential or proprietary. You grant to Sponsors a non-exclusive, non-revocable, worldwide, perpetual right to use your UGC in any manner or media now or later developed, including the right to change, create derivative works, sublicense, assign and commercialize without any payment due to you.

You are responsible for ensuring that any UGC that you post does not, and will not, violate the rights of any third party rights of any kind. You warrant and represent that you own or control all rights in any UGC that you submit.

1. Sponsors
Foam Magazine (Madavor Media, 85 Quincy Ave, Suite B, Quincy, MA 02169) and NIKE USA, Inc. (One Bowerman Drive, Beaverton, OR 97005) ("Sponsors").

2. Term
Entry into the Foam/Nike 6.0 "Living Life Full" Photo Contest (the “Contest”) begins on July 16, 2010, at midnight (12:00:00 a.m.) Eastern Time (“ET”) and ends on October 1, 2010, at 11:59:59 p.m. ET (the “entry period”). The Contest consists of the phases set forth below, as described fully in these Official Rules.

3. Eligibility
Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least thirteen (13) years old. Employees, officers and directors of Sponsors, their respective parent and affiliate companies and advertising and promotion agencies, as well as members of the immediate families (spouses, parents, siblings and children, and each of their respective spouse, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate. The Contest is subject to all applicable federal, state, and local laws and regulations. Void outside the 50 United States and the District of Columbia and where prohibited. Entrants are responsible for complying with these Official Rules.

4. How to Enter
NO PURCHASE IS NECESSARY, AND A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. To enter, visit www.foammagazine.com and follow the links and instructions to complete the registration form and upload photograph(s) that illustrate how entrants are "Living Life Full", subject to the below requirements and guidelines.

An entrant may enter the contest once. A single email address may be used by only one entrant; entries by additional entrants using the same email address will be disqualified. If an entrant exceeds any of these limits, all of that entrant’s entries will be disqualified.
No photos will be acknowledged or returned. By entering photo or photos in this Contest, Entrant grants a nonexclusive, transferable, royalty-free, worldwide license to Sponsors to edit, adapt and publish such photos in connection with the Contest and promotion of the Contest, and Sponsors may use the photos in connection with the Contest and promotion of the Contest for advertising, marketing and promotional purposes in commerce and in any and all media now known or hereafter known throughout the world in perpetuity, without attribution, compensation, permission or further notification to the entrant, his/her successors or assigns, or any other entity, unless prohibited by law. Except for the foregoing license, Sponsors do not claim ownership of any copyright in Contest Submissions. By entering the Contest, Entrant waives any rights to inspect of approve any copy that is used in connection with the photograph(s) and release Sponsors from any and all claims arising out of use by Sponsors for the purposes stated above, including any claims for libel, invasion of privacy or breach of copyright. Sponsors are not responsible for lost, late, incomplete, invalid, damaged, misdirected, or blurred or otherwise indiscernible photos, which shall be disqualified.

Photograph Requirements:
Each entry must comply with the following requirements (the "Photograph Requirements"):


  • Photographs must be in digital format. No print or film submissions will be accepted for entry into this Contest;

  • The photograph need not be taken with a digital camera; scans of negatives, transparencies, or photographic prints are acceptable;

  • All digital files must be 2 megabytes or smaller, must be in JPEG or .jpg format; optimal size is 1024x768 but other sizes will be allowed.
  • Photos must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;

  • The photos must, in their entirety, be a single work of original material taken by the contestant;

  • The photos must not, in the sole and unfettered discretion of the Sponsors, contain material that is inappropriate, indecent, obscene, hateful, tortuous, defamatory, slanderous or libelous;

  • The photos must not, in the sole and unfettered discretion of the sponsors, contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; and;

  • The photos must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where photos are created.

  • Minor burning, dodging and/or color correction is acceptable. Hand tinting is acceptable, as is cropping. Any changes to the original photographs not itemized here are unacceptable and will render the Photograph ineligible for a prize.

The photograph must NOT contain:


  • Entrant wearing a team uniform, or mentioning a team name;

  • Nudity, lewd or vulgar behavior;

  • Material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights;

  • Images and/or artwork that that are copyrighted, trademarked, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material;

  • Gratuitous violence;

  • Dangerous stunts;

  • Real weapons of any kind, including, but not limited to, guns, knives or projectiles;

  • Drug use;

  • Smoking;

  • Material that is hateful, tortuous, defamatory, slanderous or libelous;

  • Material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by Federal, State, or Local Law, Ordinance, or Regulation; and

  • Material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Submission is created.

Failure of any entry to comply with the above restrictions, as determined by Sponsors in their sole discretion, will result in disqualification.
The entries will be judged in accordance with the Judging Criteria, as defined below. All entries must be submitted and received by October 1, 2010, at 11:59:59 p.m. ET. Proof of submission is not proof of receipt. Sponsors reserve the right to examine the original photographs/source material in order to confirm compliance with these Rules.

5. Contest Prize
The following prize will be awarded: ONE (1) GRAND PRIZE: Fall 2010 Nike 6.0 Women's line (all colors, all styles, subject to availability and selected at Nike's sole discretion). Approximate Retail Value ("ARV"): $500. Actual value may vary.

6. Winner Determination
Qualified judges determined by Sponsors in their sole discretion will select the winner based on entrants "Living Life Full." Foam magazine readers, like Nike 6.0 athletes, are constantly on the move: creating, socializing, surfing, snowboarding, giving back, and making change, in short "Living Life Full." Send in your best photo or collection of photos (3-5) that capture what it means to be Living Life Full. Entrants should document what inspires them by everyday life, relationships, culture and places that hold memories. Winner subject to verification of eligibility.

7. Winner Requirements
Grand Prize winner will be notified by the email or phone provided on the entry form on or around October 10, 2010. The potential Grand Prize winner will be required to execute and return to Sponsors, within ten (10) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability and (where permitted) Publicity Release (“Affidavit”) in order to claim his/her prize. If the potential Grand Prize winner is disqualified for any reason, the next best entry as determined by the judges using the Judging Criteria will be deemed the potential winner of the Grand Prize. Acceptance of prize shall constitute and signify winner’s agreement and consent that Sponsors may use the winner’s, name, city, state, likeness, Contest entry and/or prize information in connection with the Contest, in commerce and in all media worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law.

8. Limitation of Liability
By entering this Contest, all entrants agree to release, discharge, and hold harmless Sponsors and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
Sponsors assume no responsibility for any of the following in connection with the Contest: any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries; or alteration of entries. Sponsors are further not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, fraud by any entrant, or any combination thereof, including without limitation any injury or damage to entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials in this Contest.

9. Conditions
THIS CONTEST IS VOID OUTSIDE THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, AND WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the state of Massachusetts and the forum for any dispute related to the Contest shall be in Massachusetts. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or on connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply in some jurisdictions. Entries void if the Sponsors determine the photograph to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, obtained through fraud or theft or otherwise non-compliant with these Official Rules.

By participating, entrants also agree (a) to be bound by these Official Rules; and (b) that the decisions of the Sponsors are final and binding with respect to all matters relating to the Contest. By accepting a prize, the winner agrees that Sponsors may use winning photographs and winner's name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest without further compensation or approval (except where prohibited by law).

The Sponsors reserve the right to verify the validity and originality of any entry and/or entrant (including an entrant's identity and address), and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsors to enforce any of its rights at any stage does not constitute a waiver of those rights.

10. Right to Cancel or Suspend Contest
If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to cancel, terminate, modify, or suspend the Contest. In such event, no prize will be awarded. If Sponsors elect to cancel or terminate the Contest under any of the circumstances described above, Sponsors will not retain any rights in the submitted photographs.

11. Winners List
Winner's name will be available online at www.foammagazine.com after November 1, 2010 following verification of winner. The winner will also be announced in the Oct/Nov 2010 issue of Foam Magazine and on www.foammagazine.com. Alternatively, for name of winner, send a self-addressed, stamped envelope to Foam/Nike 6.0 Contest Winners, Madavor Media, 85 Quincy Ave., Suite B, Quincy, MA 02169.

12. Data Privacy
By entering, entrants agree that personal data, including without limitation name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsors in order to verify the participant's identity, postal address, and telephone number or to otherwise verify the participant's eligibility to participate in the Contest. Participants have the right to access, review, rectify, or cancel any personal data held by Sponsors by writing to Foam Magazine, Madavor Media, 85 Quincy Ave., Suite B, Quincy, MA 02169. Personal data will be used by Sponsors and affiliates exclusively for the purposes stated herein.
